The email above should not be treated as a formally designated DMCA agent unless ZUNO has completed the applicable designation requirements.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ZUNO IMPORTS, LLC AND ITS OFFICERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE WEBSITES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO THE WEBSITES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID DIRECTLY TO ZUNO FOR THE RELEVANT SERVICE OR PRODUCT DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

THESE LIMITATIONS APPLY ONLY TO THE EXTENT PERMITTED BY APPLICABLE LAW AND DO NOT LIMIT LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED, INCLUDING ANY NONWAIVABLE CONSUMER RIGHTS OR LIABILITY FOR FRAUD, WILLFUL MISCONDUCT, OR OTHER MATTERS THAT THE LAW DOES NOT PERMIT US TO DISCLAIM.

SOME STATES DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY OR EXCLUSIONS OF DAMAGES. IN THOSE STATES, THE APPLICABLE LIMITATIONS WILL APPLY ONLY TO THE EXTENT LEGALLY PERMITTED.

17. Indemnification

To the extent permitted by applicable law, you agree to be responsible for losses, liabilities, and reasonable costs arising directly from your unlawful use of the Website, your material breach of these Terms, or your infringement of another person's rights.

These Terms will be governed by the laws of the State of Michigan, without regard to its conflict-of-law principles, except where applicable federal law or mandatory consumer protection law provides otherwise.

Any dispute arising out of or relating to these Terms or the Websites will be brought in a court of competent jurisdiction, subject to applicable law.

You and ZUNO Imports, LLC consent to the jurisdiction of the state and federal courts located in Michigan, where such consent is enforceable.

Nothing in this section deprives consumers of mandatory rights to bring claims in another forum where applicable law grants those rights.

19. Changes to These Terms

We may revise these Terms from time to time.

The updated version will be posted on the Websites with a revised effective date. Where required by law, we will provide additional notice or obtain consent before material changes take effect.
